Terms and Conditions for Property Photography Services
These Terms and Conditions ("Terms") apply to all photography, videography, floorplans, drone work, and related services ("Media") provided by Northpoint360 Property Marketing Ltd. ("the Photographer") to the client ("Client") named on the invoice.
1. Definitions

Media: All photos, videos, floorplans, virtual tours, or any other deliverables produced.

Client: The estate agent, lettings agent, property professional, or business named on the invoice.

Property: The site, building, or location to be photographed.
2. Booking & Cancellations
-
Bookings must be made in advance and can be arranged via email, phone, WhatsApp, or the agreed booking system. Bookings made with less than 24 hours’ notice are subject to availability and may not be guaranteed.

Cancellations or rescheduling must be made at least 24 hours before the scheduled appointment time. Cancellations made with less than 24 hours’ notice, or failure to provide access at the agreed time, may incur a fee of 50% of the agreed service price.

Poor weather may result in the rescheduling of drone work or external photography at the sole discretion of the Photographer. The Client may not request rescheduling based on conditions such as cloud cover or lack of sunlight. Blue skies and other enhancements are typically added during post-production editing.

Interior photography is not weather-dependent and will proceed as scheduled unless otherwise agreed. Rescheduling due to weather conditions that do not affect interior photography may be treated as a late cancellation.

The Photographer reserves the right to reschedule bookings in the event of circumstances beyond their control, including but not limited to illness, travel disruption, or equipment failure.
3. Copyright & Usage

All Media remains the intellectual property of the Photographer. Copyright is retained in full at all times unless expressly transferred in writing.

Upon full payment of the invoice, the Photographer grants a non-exclusive, non-transferable licence to the Client named on the invoice to use the Media solely for the marketing and promotion of the specific property or properties photographed.

Where a third party (such as a property owner or vendor) pays the invoice, this does not confer any rights or licence to that third party. The licence is granted solely to the Client named on the invoice, regardless of who makes payment.

The Media may not be sold, sublicensed, transferred, shared with third parties, edited, or reused for any other property or project without the Photographer’s prior written consent.

Requests for third-party use (e.g., by interior designers, developers, staging companies) must be made in writing and may incur a separate licensing fee.
4. Online publication and Credit

Free usage of the Media is permitted in relation to the active marketing of the specific property photographed, including on property portals and agent websites.

Permission is granted for use on free-access, non-commercial editorial websites (such as online newspapers, blogs, or digital publications), on the condition that the following credit and hyperlink is displayed directly beneath each instance of every image used:

Usage in print publications, paywalled content, commercial campaigns, or sponsored content is not permitted without a separate licence and prior written agreement.

Failure to provide proper attribution may result in removal of permission for use and/or a licensing fee being charged.
5. New Technology and AI Use
-
The Photographer may use AI-based tools and emerging technologies to assist in the creation and delivery of Media. This may include image enhancement, floorplan generation, video production, object removal, or other editing processes. All such outputs are subject to the same copyright and usage terms as traditionally produced work.

Clients are strictly prohibited from uploading, submitting, or incorporating the Media into any artificial intelligence (AI) systems, machine learning models, or generative content platforms (such as image/video generators or training datasets) without the Photographer’s prior written consent.

The Media must not be altered, manipulated, or enhanced using AI or similar technologies in a way that misrepresents the property or creates derivative works beyond the originally intended marketing use.

Any use of the Media to generate synthetic content (e.g., AI walkthroughs, renders, or alternative versions of the property) is not permitted without a separate licensing agreement.

As technology evolves, the Photographer reserves the right to update these terms at any time. Continued use of the services constitutes acceptance of the most current version of these terms.
6. Payment Terms

Invoices are issued to the Client named on the invoice and are payable in full by the due date specified on the invoice, unless otherwise agreed in writing. Payment terms may vary depending on the type of client or service, and will always be clearly stated on the invoice.

The Client is responsible for ensuring full payment, regardless of whether a third party (e.g., property owner or vendor) pays on their behalf.

The Photographer reserves the right to withhold delivery of Media until payment has been received in full.

Late payments may incur interest at a rate of 5% of the total invoice amount for every 14-day period (or part thereof) the payment remains outstanding.

If payment is not received within 45 days of the due date, any previously granted usage rights will be automatically revoked until full payment is received. Continued use of the Media after rights have been revoked constitutes a breach of copyright and may result in legal action or additional licensing fees.
7. Turnaround Time
-
Standard delivery time for photography and floorplans is typically within 24–48 hours from the time of the appointment.

Videos and virtual tours are typically delivered within 2–4 working days.
-
Turnaround times are estimates and may vary depending on workload, complexity, or specific project requirements.
-
Expedited delivery may be available upon request and may incur an additional fee.
-
Delays may occur if the property is not ready at the time of the appointment, if access is restricted, or in cases of poor weather affecting drone operations.

The Photographer does not guarantee the long-term storage of Media after delivery. Clients are advised to download and securely store all files promptly. Retrieval of archived files, if available, may incur an administration fee.
8. Client Responsibilities

The Client is responsible for ensuring the Property is clean, tidy, and presentable at the time of the appointment. The Photographer is not responsible for cleaning, decluttering, or staging the Property.

The Photographer may move small items (such as cushions, chairs, or décor) to optimise the composition of the imagery, but will not undertake general tidying or housekeeping.

The Property will be photographed as presented. If the Property is not ready at the time of the appointment, the Photographer reserves the right to proceed as-is, reschedule, or charge for additional time on site.

The Client must provide accurate access details and instructions in advance. If access cannot be gained at the scheduled time due to incorrect or incomplete information, the appointment may be treated as a late cancellation.
9. Retouching and Edits

Standard editing is included in all photography and typically covers colour correction, exposure adjustment, straightening, cropping, sky replacement, and removal of minor distractions (e.g., small items, cords, signage).

Requests for extensive object removal, virtual staging, digital decluttering, or significant image alterations are not included as standard and may incur an additional fee.

The Photographer reserves the right to refuse edits that may misrepresent the property or breach advertising standards.

Any additional editing requests must be submitted within 7 days of delivery. Further revisions requested outside of this period may be treated as a new service.
10. Limitation of Liability

The Photographer will perform all services with reasonable skill and care. However, they shall not be held liable for any indirect, incidental, or consequential loss, including but not limited to loss of profit, missed marketing opportunities, or delays in property sales or lettings resulting from the use or delivery of the Media.

Floorplans are created using measurement tools and software deemed accurate at the time of production, but they are provided for illustrative purposes only. The Photographer accepts no liability for any inaccuracies or discrepancies in dimensions, layout, or scale.

Drone services are subject to appropriate weather conditions, CAA airspace regulations, and on-site risk assessments. In the event drone work cannot be carried out as planned, it will be rescheduled or cancelled at the Photographer’s discretion, with no additional charge for rescheduling due to weather.

The Client is responsible for checking all deliverables upon receipt. Any issues or concerns must be reported within 7 days of delivery.
11. Portfolio Rights

The Photographer reserves the right to use any Media produced for inclusion in their professional portfolio, website, social media, marketing materials, and other promotional purposes.

This may include public display of photographs, videos, and floorplans unless the Client explicitly requests otherwise in writing prior to the shoot.

Where reasonably possible, identifying details such as property addresses will be excluded upon request.
-
The Photographer will never disclose confidential client information in portfolio use.
12. Governing Law

These Terms and any disputes arising under them shall be governed and construed in accordance with the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such disputes.
13. Amendments
-
The Photographer reserves the right to amend or update these Terms and Conditions at any time to reflect changes in business practices, legal requirements, or technology. The most current version will be available upon request or published on the Photographer’s website (if applicable). Continued use of the Photographer’s services following any amendments shall constitute acceptance of the revised Terms, unless the Client notifies the Photographer in writing of any objection within 7 days of receiving the updated Terms.
